CONSTITUTION OF CORPORATION
The term ’Corporation’ means the Municipal Corporation of Brihan Mumbai constituted under the Mumbai Municipal Corporation Act, 1888, as modified from time to time which consists of 227 Councillors directly elected at Ward elections and 5 nominated councillors having special knowledge or experience in municipal administration to be nominated by the Corporation (Sec.3&5). The period of Corporation is of 5 years from the date of its first meeting (Sec.6) and the term of office of the Councillors shall be co-terminus with the duration of the Corporation (Sec.6A). The Corporation at their special meeting after General elections appoint amongst the Councillors one of its Mayor and another to be the Dy. Mayor as per ordinance No. BNM.5005/46/C.R.7/Part-IV/UD-32, dated the 15th February 2007. In every other case meeting is fixed by the Mayor or in the event of his absence by the Dy. Mayor or Chairman, Standing Committee. Corporation also nominate the members of the (1) Statutory Committees, (2) Special Committees (3) Consultative Committees and (4) Sub-Committees of the Corporation.
CONDUCT OF BUSINESS
The Corporation meets for the dispatch of business in the Municipal Head Office and shall from time to time, make such regulations with respect to the summoning notice, place, management and adjournment of such meeting and generally with respect to the mode of transacting and managing the business of the Corporation including the submission, asking and answering under Sec.66A, as they think fit (under Sec.36):- There shall be one ordinary meeting of the Corporation in each month. The special meeting of the Corporation after General Elections is to be held in the month of March, the day, the time and the place to be fixed by the Municipal Secretary in consultation with the Ex-Mayor and Commissioner for the appointment of Mayor and Dy. Mayor in pursuance of the ordinance No. BNM.5005/46/C.R.7/Part-IV/UD-32, dated the 15th February 2007. Every notice of a meeting shall specify day, time and place at which such meeting is to be held and the business to be transacted thereat by giving advertisement in the local newspaper and circulate the Agenda with accompaniments to the members at their residential address by the Municipal Secretary. The Mayor or in the event of his absence Dy. Mayor or Chairman, Standing Committee call a special meeting of the Corporation, upon a written requisition signed by not less than one-sixth of the whole number of Councillors [Sec.36(d)]. Quorum of one-fifth of the whole number of Councillors is required for transacting the business before the meeting of the Corporation (Sec.36f). Every meeting shall be presided over by the Mayor or in the event of absence of Mayor, by the Dy. Mayor and or if both the Mayor and the Dy. Mayor are absent by such one of the Councillors present as may be chosen by the meeting to be the Chairman for the occasion. The Commissioner or in the event of absence of Commissioner, the Additional Municipal Commissioner, Dy. Municipal Commissioner or Director has right to remain present in the meetings of the Corporation and to take part in the discussions, but has no right to vote upon or to make any proposition in the meeting. As per Sec.127 of the Mumbai Municipal Corporation Act, on or before 10th of the month of March budget estimates 'A' , 'B' and 'C' prepared by the Standing Committee and budget estimate 'E' prepared by the Education Committee with the report of the Standing Committee thereon shall be laid before the Corporation for consideration and final approval.
